Terms of Use of the Bazar de Asia Central Digital Platform

This User Agreement (“Agreement”) defines the terms and conditions under which users — whether consumers, suppliers, cultural institutions, or business partners — may access and use the integrated services of Bazar de Asia Central, available at https://bazarca.com and related mobile or digital applications.

1. Nature and Mission of the Platform
Bazar de Asia Central is not a traditional online store. It is a multi-functional cultural, commercial, and logistical platform designed to:
Facilitate the export and sale of Central Asian goods (food, spices, textiles, crafts, cosmetics) to the Spanish and European markets
Promote cultural diplomacy and public understanding of Central Asia through gastronomy, education, and events
Serve as a digital marketplace, distribution hub, event space, and media center
Act as a bridge between governments, businesses, diaspora communities, and European consumers
The Platform integrates:
A retail and wholesale e-commerce system
A supplier management and logistics interface
Digital tools for education, culture, and community
A physical center in Barcelona, with future expansion across Europe
2. Legal Framework
This Agreement and the entire operation of the Platform are governed by:
Spanish national law, including:
Real Decreto Legislativo 1/2007 (Consumer Protection)
Ley 34/2002 (E-commerce and Information Services)
Ley Orgánica 3/2018 (Personal Data Protection)
European Union legislation, including:
General Data Protection Regulation (GDPR)
Directive 2011/83/EU on Consumer Rights
Regulation (EU) 2019/1150 on online platforms
ePrivacy Directive 2002/58/EC
Compliance with international trade regulations (including food, customs, labeling) is also part of our model.
3. Eligibility and Access
Access to the Platform and its services is granted under the following conditions:
You must be at least 18 years old and legally capable
You must agree to the terms outlined herein
You must not have been previously suspended or banned
Users may act as:
Private consumers (B2C)
Business buyers (B2B)
Registered suppliers from Central Asia
Institutional or cultural partners
Different rights and obligations may apply based on your role.
4. Platform Services and Functions
The Platform provides:
A. E-commerce Services
Online retail sales of imported and local Central Asian products
B2B supply chain access (wholesale, restaurant, catering, hospitality)
Product authentication, certification, customs management
Dynamic inventory and fulfillment system
B. Cultural Programming
Gastronomic and artisan events
Language and cultural education programs
Cross-cultural marketing collaborations
Integration with embassies, cultural centers, and NGOs
C. Digital Services
Customizable seller dashboards
Marketplace listing tools
Mobile apps and e-logistics platform
CRM systems and automated analytics
5. User Obligations and Conduct
By using the Platform, you agree to:
Use the services lawfully and ethically
Respect other users, administrators, and service providers
Not interfere with, copy, or extract proprietary data
Not misrepresent yourself or your goods (if a supplier)
All users must refrain from:
Posting or sharing illegal or harmful content
Engaging in fraudulent transactions or chargebacks
Attempting to bypass payment systems
Uploading malware, spam, or unethical advertising
Breach of these obligations may result in account suspension, legal action, and exclusion from future partnerships.
6. Intellectual Property
All Platform content — including branding, code, texts, layout, images, and structures — is the exclusive property of Jarteppa Consulting S.L. and/or its licensors. This includes:
Visual identities and trade dress
Product photography and descriptions
Educational and event materials
E-commerce and marketplace software code
You may not:
Reproduce, distribute, modify, or exploit content without written consent
Use our brand or images for resale or unauthorized campaigns
Register similar domains, names, or marks
7. Use of Supplier and Product Data
Suppliers from Central Asia are responsible for:
The legality and accuracy of product descriptions
Providing valid export certificates and origin documentation
Ensuring the safety and labeling of food and cosmetics
Complying with EU customs, food safety, and labeling laws
The Platform reserves the right to suspend or delist any product or seller who:
Violates applicable law
Misrepresents product origins
Fails to meet agreed timelines or conditions
8. Accounts, Security, and User Data
Accounts must be created with true and verifiable information. You must:
Keep your login credentials secure
Not share access with unauthorized third parties
Notify us of any breach or misuse
Your data is processed in accordance with our Privacy Policy, and only for the purpose of delivering services, unless you consent to further use.
9. Data Protection and Privacy
We adhere to the principles of GDPR, including:
Lawful, fair, and transparent data collection
Purpose limitation and data minimization
Right of access, correction, and deletion
Privacy by design in all our systems
Sensitive data (e.g., billing info, trade credentials) is encrypted and stored securely.
10. Payments and Tax Compliance
Payments are processed through secure third-party providers. All payments are:
In Euro (€)
Inclusive of VAT where applicable
Accompanied by digital invoicing
The Platform is registered for tax purposes in Spain and complies with obligations including:
Issuing correct VAT invoices
Reporting cross-border transactions
Enabling suppliers to generate tax records
11. Dispute Resolution and Legal Claims
Disputes may be resolved via:
Our internal customer support channel
EU Online Dispute Resolution portal (https://ec.europa.eu/consumers/odr)
Arbitration or court processes in Barcelona, Spain
We encourage dialogue and mediation as a first step.
12. Platform Availability and Limitations
We strive for 99% uptime but cannot guarantee uninterrupted service. We are not responsible for outages due to:
Hosting failures or cyberattacks
Maintenance windows
Global events (pandemics, war, customs embargoes)
You acknowledge that:
Access may be limited temporarily
Certain functions may be modified or discontinued
13. Termination and Suspension
We may suspend or terminate access:
For violation of terms or law
For inactivity over 12 months
By written notice from public authorities
In serious cases (fraud, endangerment), legal proceedings may follow.
14. Agreement Updates
This document may be updated periodically. The most current version is always available on the website. Continued use of the Platform constitutes acceptance of changes.
